A residential sublease agreement

A residential sublease agreement (also sometimes known as a sublet agreement) is required and used when a tenant who is renting out a property wishes themselves to rent out that property to someone else again. The lease grants the first tenant the property rights to be able to offer a sublease to another party. The sublease agreement can be used on almost any property, from apartments, condominiums and houses to up to and including garages and even parking spaces. In general, such subleases do not require the consent of the original landlord, unless the original lease actually states that subleasing is prohibited (although this is not the case for everywhere and you should at least check before attempting to sublease without notifying the original landlord!).
It is advisable however, even if you are legally allowed to do so, to at least consult the original landlord on the issue in order to prevent any unpleasantness. If you are leasing a property and considering subletting yourself, it is important to note that any damage done to the property by your sublease will, as far as the original landlord is legally concerned, be your responsibility to ensure payment for. You will also be required to keep up your original rental agreement to the landlord, even if the person you are subleasing the property fails to live up to their obligations to pay you the agreed to rental money on time. There are exceptions to this, however; If the sublease agreement is that of an Express Assumption Agreement, that makes the sub-lessee responsible to the landlord. If you are in the position of leasing from someone who is already leasing, it is important to remember that the original landlord maintains the right to terminate the original lease, which will in turn terminate your sublease whether you like it or not.
There can be many reasons why a leaser would decide to sublet their property. Many tenants can often find the property they are leasing is too big for them or has space which they themselves do not use — such as the garage etc — and thus subleasing that room to someone else makes sound financial sense (particularly in the current tough economic climate) and could even help to assist them in paying their own original lease agreement.

How to Evict an Unreliable Tenant?

In case you wonder where to find an answer to the ‘what to do if my renter is not paying rent question’, just continue reading the article. When facing with such a situation there is no need to panic. First of all, go to the lessee and talk to them in order to clarify the matter. Express your demands and set terms for payment.
However, if the renter disregards your admonition, then you have to take more serious actions. This means that you have to prepare a 3-day eviction notice. This is a document used by the landlord to inform the lessee that you want to terminate the contract. Not only non-payment of the rent but also the excess of sound limits, causing damage to the building and property are the most common reasons to issue the letter.
The document gives the tenant the opportunity to settle a problem for three days. If they fail to do so, they have to leave the building. Otherwise, the landlord can sue.
Read below how to create the notice.

What Information to Include in the Letter?

First of all, find the appropriate fillable blank on the Internet. Evaluate the data you have to provide. Below read the approximate content of the letter.

  • Write about the property and the lessee in the first paragraph.
  • Indicate the reason for preparing the notice.
  • Specify conditions and demands. Sign the document by typing, drawing or uploading a signature from any internet connected device.
  • Send the 3-day notice to the recipient via email, fax or sms.

Don’t forget to attach the Certificate of service. If necessary, print out the blank form and fill it out by hand. Make some copies.

Tips to prepare a lease agreement

Renting out a property is a complicated process, that should be supported by a range of documents. It is very important to make your tenant sign a lease agreement in order to avoid any possible misunderstandings. Each basic residential lease agreement template should include certain basics. We offer you to look through the list of tips:
  1. Any agreement completed correctly has answers on four main questions: “who?”, “when?”, “where?” and “what?”. Clearly state who the lease is between. Don’t forget to include the third party if your lawyer or an agent is involved in the leasing.
  2. Identify the property. Specify the name and the accurate address. Include house number, street name, apartment number, house, state and postal code.
  3. Determine the term of the rental contract. It’s very important for every party to know when the contract is valid. Include the exact date (day, month and year) when the lease begins and ends.
  4. It’s advisable to clearly state the full amount of rent due over the period of the entire lease and then break it down by the amount due per month. Choose the date on which the payment is due.
  5. The contract should be signed to become legally binding. The signatures serve as a confirmation that the landlord and the tenant agree to follow the terms of the accord. The tenants should be over the age of 18 and named in the “parties” clause of the document.

Follow five simple rules to close the deal successfully. Make a hard copy of the contract to keep it for your records. Give another one copy to your tenant. If you have any additional questions about any specific circumstances ask a legal counsel for advice

What is an eviction notice?

There is a number of reasons to evict a tenant. As a landlord you may present various notices to your tenant, but there is a simpler solution. Use a 3-day notice, that is legal form to ensure that you have accurate documentation of the dispute and that you take smooth formal steps to resolve any breach of lease terms with a tenant. For example, you may use eviction notice to tenant by landlord to inform your tenant, who fails to pay on time, that he or she can either pay the amount due or vacate the rental property. By sending this document you may give the occupant a deadline for paying or ask him or her to move out the property. Another reason may be property violation. Any lessor may give his tenant the option to either amend the violation or to leave the facilities. There are no strict rules about what formal information to include to your lease, but here is a piece of advice of how to make your eviction notice exhaustive and legally binding.

What to include in the eviction notice?

State the accurate reason of eviction. Consider, that you can’t legally make your lessee move out without court order. The following information should be obligatory provided in the document.

  • current date;
  • names of a landlord and a lessee;
  • description of property that is going to be leased;
  • lease period;
  • amount of money to be paid;
  • condition of the property and terms of its maintenance;
  • amount payable of taxes and utilities;
  • other obligations and requirements of the parties;
  • signatures.

You are provided with ability to add your signature electronically, by typing, drawing or uploading.
